These terms and conditions apply to all sales made by PROCALCANI – Importação e Exportação de Calçado, Lda through the website www.guttenshoes.com, the site of its registered trademark “Gutten”.

Hereinafter, in these terms and conditions, the position of PROCALCANI – Importação e Exportação de Calçado, Lda will be described by its brand name, “Gutten”.

These terms and conditions regulate the distance selling relationship between Gutten and the user or customer, in accordance with the legal provisions in force.

Gutten reserves the right to make any modifications it deems appropriate, without prior notice, to these General Conditions. These modifications can be made by any method permitted by law, and will be applicable as long as they are published on the website until they are validly modified by subsequent modifications. However, Gutten reserves the right to apply, in certain cases, Specific Contracting Conditions instead of these General Conditions, when it deems appropriate, duly notifying the customer in an appropriate manner.

The purpose of the website is the commercialization of footwear and accessories of the Gutten brand.

As a user or customer, you expressly declare that you know, understand, and accept the terms of use and these general contracting conditions. Additionally, you declare that you are of legal age and have the legal capacity necessary to access the Gutten website and contract through it.

If you wish to purchase our products, you can go to the corresponding section of our online store.

You can register as a website user to make your purchase.

In accordance with the current legislation on data protection, Gutten informs you that the personal data collected during the registration process and subsequent purchase will be included in the processing system owned by Gutten, with the purpose of processing your actions and managing the subsequent actions arising therefrom.

Your data will be kept for the strictly necessary time to fulfill the aforementioned purpose, except if legally required to keep it for other periods.

We inform you that the legal basis for the processing of your data is the correct execution of the contract between the parties and your consent.

Gutten may transfer the personal data of customers to third parties providing services on its behalf, such as logistics companies and payment processors.

Gutten guarantees that the third parties with whom it shares customers' personal data comply with privacy and data protection standards.

In accordance with the rights granted by the current data protection legislation, you can exercise your rights of access, rectification, restriction of processing, erasure, portability, and objection to the processing of your personal data, as well as withdraw your consent to such processing, by sending your request to the postal address above or to the email site@gutten.pt. You can also contact the competent Supervisory Authority to lodge any complaints you deem appropriate.

During the purchase process, you must identify yourself with your username and password. These data will not be made public. The user is responsible for treating confidentially and responsibly the identity and password obtained during registration as a customer, not being able to transfer them to other users. You can change the registered information on the website at any time, in your customer area. In this same section, you will have access to a history of your orders. This is only a consultation section. However, some procedures are allowed, such as deleting records that you no longer consider necessary to view.

Upon completing the purchase process, you will receive a purchase confirmation by email. It is necessary to provide a valid email address during the purchase process. If you do not receive the confirmation within 24 hours after completing your order, please contact Gutten through the email address site@gutten.pt.

All website content is available in Portuguese, English, and Spanish.

When you receive the product at the delivery address you provided, it will also include an invoice or a copy of the order.

Basic Product Characteristics

The products offered in our online store include a photograph and the basic characteristics of the products, which are the information provided by the manufacturer. The color of the product, as shown in the photograph, is not binding. The color of the product is identified in its characteristics.

Prices

All products display the sale price in euros and include Value Added Tax (VAT).

Price changes - The prices of the products displayed on the website are subject to change. Gutten reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

Price errors - Please note that, even though the site is updated with great attention, it is possible that the price information on the site contains errors. Gutten does not commit to the offer and reserves the right to cancel your order in case such an error occurs.

Shipping and Transportation Costs

Gutten only makes shipments charging an amount of €4.99 in Portugal and Spain and charging an amount of €15,99 for the rest of the European Union.

For orders over €34.99, shipping will be free for Portugal and Spain.

For orders over 120€, shipping will be free in the European Union.

Payment Methods

You can pay for your order using any of the following methods. You must indicate which one you choose during the purchase process:

  • VISA, MASTERCARD credit card, Maestro, Apple Pay, Google Pay or Shop Pay

All operations involving the transmission of personal or banking data are carried out in a secure environment, on a server based on standard SSL (Secure Sockets Layer) security technology. All the information you send us is encrypted to travel through the Web.

Furthermore, your credit card data is entered directly on the bank's website, on the bank's POS (Point of Sale Terminal), and is not entered or recorded on any Gutten server.

When paying with VISA, MASTERCARD, Maestro, Apple Pay, Google Pay or Shop Pay, you may be asked for the following information: card number, expiration date, and a Validation Code that corresponds to the last three digits of the number printed in italics on the back of your card, which constitutes an additional guarantee of the transaction's security.

This payment method is only valid on the website.

When the amount of a purchase has been fraudulently or improperly charged using a payment card number, the cardholder may demand the immediate cancellation of the charge. In such cases, the corresponding debit and credit entries in the supplier's and cardholder's accounts will be made as soon as possible.

However, if the purchase was indeed made by the cardholder and the request for a refund was not due to the exercise of the right of withdrawal and, therefore, the cardholder had unduly demanded the cancellation of the charge, the cardholder will be liable to Gutten for compensation for the damages caused as a result of the cancellation.

  • Bank Transfer

Transactions by bank transfer should be made to IBAN PT50 0018 220601794160020. We request the payment receipt to be sent to the email site@gutten.pt, and we ask for your understanding for the extension of the shipping period to 2 to 3 business days to confirm receipt of the payment.

Order Delivery Times:

  • 1 to 3 business days in Mainland Portugal, Madeira Archipelago, and Mainland Spain.

  • 5 to 7 business days in the Azores Archipelago and Spanish Archipelagos.

  • 1 to 3 business days (approximately) in the European Union.

The availability of the products offered by Gutten may vary depending on customer demand. Although Gutten periodically updates the stock, the product requested by the customer may be out of stock at that moment. If it is not possible to supply the product due to unavailability, Gutten will notify the customer by email as soon as it becomes aware of this situation. In no case will the period for sending this notification exceed a maximum of 30 days. Gutten can offer two options: supply a product with similar or higher quality characteristics to the customer at the same price or, except for justified reasons that can be proven by Gutten, refund the amounts paid for the canceled order within the same period.

Order Delivery Methods

Gutten uses the following delivery methods:

Orders for Mainland Portugal, Spain, and the rest of the European Union: MRW

Orders for the Azores and Madeira Archipelagos: CTT in registered mail

Returns and Exchanges

Return due to right of withdrawal: The Customer can return the item, without any need for justification, within 14 days.

Return due to defect/non-conformity of the item: If the item has any defect, the Customer should contact Gutten via email site@gutten.pt, informing us of the condition of the product and its defects. The email should indicate the reason for the return and attach a photograph of the item and the defect so that we can process your claim.

If Gutten confirms the defect or non-conformity of the item and validates the reasons for the return, it will send the replacement item, bearing the transportation costs. In case of stock shortage, the total amount paid will be refunded, including the shipping costs when applicable.

Exchanges: The Customer can exchange the item for another size, color, or other items, indicating which new items they want to exchange for. If the value of the exchanged items is lower or higher than the initially paid amount, the customer will be refunded or will have to pay the difference.

Procedure for returns and exchanges:

The customer must contact us via email: site@gutten.pt to inform us of their intention to return/exchange. They have a period of 14 days after the delivery of their order to inform us of their intention to return/exchange.

The items should be placed in their original packaging, properly conditioned, and without any signs of use, along with the labels, the corresponding invoice, or proof of purchase.

The customer must return or deliver the product directly to Gutten by sending it to the address:

The costs of returning the items are always borne by the customer. In cases where Gutten confirms the return due to a defect in the items, this value will be subsequently refunded to the customer.

After receiving the items in our warehouse, if they are in their initial conditions, Gutten will proceed to replace/exchange the items (except in the case of withdrawal) and/or refund the amount to which the customer is entitled (if applicable), as soon as possible.

Gutten reserves the right to refuse exchanges and returns if the communication was made outside the established period and/or if the items are not in the mentioned exchange and return conditions.

Refund of Payment

The amounts paid by the customer will be refunded by bank transfer.

In case of dispute, the consumer can resort to an alternative consumer dispute resolution entity
